Privacy policy

This policy explains what personal information Nikographie collects, why, who it is shared with, how long it is kept and what your rights are. It applies to nikographie.ca and to our communications with you. It is written under Québec's Act respecting the protection of personal information in the private sector. The French version is the reference version.

1. Who we are

Nikographie, a business registered with the Registraire des entreprises du Québec (NEQ 2280587041).

2. Information we collect

Booking form

Your name, your email, the service you are interested in and, if you choose to provide them, a phone number, the project location, a preferred date, an approximate budget and a message. The form also sends the version of this policy you accepted and the display language. Please do not include sensitive information.

Emails and conversations

Whatever you choose to write to us.

Clients

If you sign a contract: the information needed for that contract and for billing (for example address, phone number, project or event details, payment history).

Images of people

During shoots, we capture images and sometimes the voices of people. When they can identify someone, they are personal information. How they are used is governed by the contract and by the consent of the people concerned (section 5).

Technical data

When you visit the site, our web host, Rapidenet, whose servers are in Canada, automatically records technical logs (IP address, browser type, page requested, date and time) to run and secure the site. We do not use them to identify or profile you.

The site loads its fonts from Google's servers (Google Fonts). Your browser therefore sends your IP address to Google, in the United States, when the page loads.

What we don't do

We use no audience-measurement tools, no advertising pixels and no profiling tools. We do not sell or rent your information. We make no decisions based exclusively on automated processing.

3. Why we use it

  • To answer your request and, if you wish, prepare a quote.
  • To enter into and perform a contract, and to communicate with you about it.
  • To bill and meet our legal obligations, including tax obligations.
  • To keep the site secure and block automated submissions (spam).

We do not use your information for any other purpose without your consent, except where the law allows it. We do not send newsletters or marketing messages.

4. Your consent

By ticking the box on the form, you consent to the use of your information for the purposes in section 3. You can withdraw your consent at any time by writing to us. Withdrawal does not undo what was done before, but we may no longer be able to follow up on your request.

If you are under 14, a parent or guardian must fill out the form for you.

5. Images of people and our portfolio

We use the image of an identifiable person (photo, video or voice) for promotion — website, social media, portfolio — only with that person's permission or, for someone under 14, their parent's or guardian's. If you recognize yourself in our portfolio and want an image removed, write to us and we will remove it from our platforms.

6. Who can access your information

Only the owner of Nikographie. We use service providers who process it on our behalf, only to provide their service to us:

  • website hosting and form processing: Rapidenet (servers in Canada);
  • email: Rapidenet (servers in Canada);
  • fonts: Google (United States), which receives your IP address;
  • where applicable, our professional advisers (for example our accountant), who are bound by confidentiality.

We may also disclose information where the law requires or permits it.

7. Information stored outside Québec

Some of our providers may store information outside Québec, including in the United States. Before disclosing information outside Québec, we assess whether it will be adequately protected, as the law requires.

8. How long we keep it

  • Requests that don't lead to a contract: deleted no later than 24 months after our last exchange.
  • Client files: for the length of the contract, then as long as our accounting and tax obligations require (generally 6 years after the end of the tax year concerned).
  • Project files and images: as set out in the contract.
  • Technical logs: according to our web host's policy.

After that, the information is securely destroyed or anonymized.

9. Security

We take reasonable measures suited to the sensitivity of the information: access limited to the owner of Nikographie, accounts protected by a strong password and two-factor authentication, and encrypted transmission (HTTPS). If a confidentiality incident presents a risk of serious injury, we will notify the people concerned and the Commission d'accès à l'information, and record it in our incident register.

10. Your rights

You can:

  • find out what information we hold about you, what it is used for and where it came from, and get a copy;
  • have inaccurate, incomplete or ambiguous information corrected;
  • withdraw your consent;
  • ask us to stop disseminating information about you or to de-index a hyperlink attached to your name, under the conditions set by law;
  • receive the computerized information you gave us in a structured, commonly used technological format.

Write to niko@nikographie.ca. We respond within 30 days. We may need to verify your identity. This is free of charge, except for reasonable transcription, reproduction or transmission costs, which we would tell you about in advance.

If you are not satisfied with our response, you can file a complaint with the Commission d'accès à l'information du Québec: www.cai.gouv.qc.ca.

11. Changes

If we change this policy, we will publish the new version here with its update date. If the change is significant, we will say so on the site and notify by email the people whose file is active.
